Air Rights

The space or air above a piece of property that by definition legally belongs to or is attached to the property. The air rights of a property can be transferred, sold or rented. The term is often associated with a building that has been built over property that is being used for another purpose (the building is said to be using the air rights). The most common examples of an air rights building are those built over a railroad track or right-of-way, or over a road or highway.

Lis Pendens

The record of notice that a legal action or suit has been filed that will potentially affect the title of a particular piece of property. This document is attached to a property’s title and will usually prevent the property from being sold until a court action or suit is settled.

Phase II Environmental Survey

Phase II Environmental Survey – A Phase II environmental survey goes further than a Phase I Environmental Survey and typically includes sampling of subsurface soils and/or ground waters, requiring the use of underground drilling or subsurface probes. Double Net Lease

After researching and touring a number of potential options, we had not yet found the ideal solution. Our tenacity paid off, however, and we located an attractive office building for sale within the targeted location.

Our long-term client, Adams County, Colorado, approached us in late 2005 and requested our help in locating and purchasing approximately 100 acres of land.
